Legislative breakthrough for wind energy and infrastructure development in Ukraine!

The UWEA welcomes the signing of Law No. 9549 by the President of Ukraine on August 5, 2025. This Law introduces essential legislative changes to facilitate land use for digital and energy infrastructure, creating a more favorable environment for wind energy projects, network expansion, and investment attraction.

Key changes regarding wind energy:

1.Easier access to land for linear infrastructure (power lines, cables, pipelines):

  • Lease or easement rights can now be obtained without competitive auctions – reducing delays in securing land for grid connection.
  • Minimum easement term: 5 years – ensuring security for investors and operators.
  • Land plots of up to 0.05 ha in forestry areas can be used without changing their land-use designation – enabling faster grid deployment for wind farms.

Impact: Grid infrastructure has long been a bottleneck for wind energy development. These simplifications eliminate red tape and accelerate project timelines.

2.Facilitated land expropriation for strategic projects in Zakarpattia region:

  • Land in Uzhhorod district can be expropriated for energy, industrial, or defense infrastructure.
  • Owners will receive triple compensation based on market value; voluntary sales receive an additional +20% premium.
  • Projects cannot be halted in court until January 1, 2027.

Impact: Zakarpattia has significant wind potential. These provisions ensure that strategic wind projects can proceed without interruption, while respecting property rights.

3. Extended transition period for new urban planning requirements – until January 1, 2028:

  • Ongoing DPT (Detailed Plans of Territory) can be approved under current rules.
  • Coastal protection zones and land use can be adjusted via DPTs.
  • Avoids disruptions for developers and ensures legal certainty for projects already in the pipeline.

Impact: Developers and financial institutions gain confidence and clarity, ensuring that ongoing wind projects stay on track.
